Attorney General activism, Virginia AG Ken Cuccinelli has put House Speaker Nancy Pelosi on notice

Our Man Ken–There He Goes Again!
by Christian Josi

In yet another admirable display of the right kind of Attorney General activism, Virginia AG Ken Cuccinelli has put House Speaker Nancy Pelosi on notice that what she and the Democratic leadership are reportedly scheming to pass Health Care ‘reform’ is not only wrong — it’s unconstitutional.

3.18.10 KConPelosi -

Amidst discussion and arguments surrounding health care reform, is the effect passage will have on the re-election of Democrats in the Fall. The health care reform legislation currently in front of Congress is so widely unpopular on both sides of the aisle that Democrats have taken up the idea for a process called, “deem and pass” to get health care reform passed through.

Deem and pass is a process by which House Democrats will be able to avoid taking recorded votes on the Senate health care bill. Given the political environment and discussion within the blogosphere and mainstream media, the motives behind enacting this process specifically for this bill are highly transparent.

In a letter to the Speaker, above, Cuccinelli wrote, “A bill of this magnitude should not be passed using this maneuver. As the President noted last week, the American people are entitled to an up or down vote.” (He’s not exaggerating when he talks of the “magnitude” of this bill. It’s said to project up 2.5 trillion dollars in new spending).

“Based upon media interviews and statements which I have seen, you are considering this approach because it might somehow shield members of Congress from taking a recorded vote on an overwhelmingly unpopular Senate bill.”

“Deem and pass,” in this context, is an egregious violation to the democratic process. I applaud AG Ken Cuccinelli for not only acknowledging this, but also for being willing to stand against the crazies pursuing it.

Taxation without Representation

By Bob Beers Thursday, March 18, 2010

Article 1 of the US Constitution, first half of the third paragraph of section 2:

Representatives and direct Taxes shall be apportioned among the several States which may be included within this Union, according to their respective Numbers, which shall be determined by adding to the whole Number of free Persons, including those bound to Service for a Term of Years, and excluding Indians not taxed, three fifths of all other Persons [Modified by Amendment XIV].

If you will notice, the US Constitution ties representation and taxes pretty tightly together. Theses links here and here will take you to a couple of sites that explain the working of our Constitutional government in plain, easy to understand language. The problem we have right now is we do not have a government that wishes to abide by the Constitution.

Typically, after a measure passes in the House, it goes to the Senate for consideration. A bill must pass both bodies in the same form before it can be presented to the President for signature into law. This rule is not spelled out in a single brief clause, but in a series of constitutional rules that in the past were considered inviolate, that is until the progressives began whittling away at what our founding fathers built with their own blood.

Speaker Nancy Pelosi is moving to merely “deem” that the House has passed the Senate health-care bill and then send it to President Obama to sign anyway.

Louise Slaughter, A New York Democrat and chair of the House Rules Committee, under orders from the Speaker, is working on crafting a “self-executing rule,” also known as a “hereby rule.” This rule will side step the constitution and allow the House to vote only once on the reconciliation corrections, but not on the actual Senate bill. Here is where it gets sticky, constitutionally speaking, if the reconciliation corrections pass, the Slaughter rule would call the Senate bill presumptively approved by the House. There would be no up or down vote by the House, not even debate on the Senate bill. The President would be sent a bill to sign into law that did not pass both houses in direct violation of the US Constitution.

If you will remember, back when the Democrats were looking at becoming the majority party after their “8 years of hell” under George Bush Jr., Pelosi promised to “drain the swamp” and create the most ethical Congress in US history. When he was a senator, Joe Biden is quoted as saying the Democrats would not “abuse power” if they become the majority as the Republicans had done. You can even find then Senator Barrack Hussein Obama claiming that his party would be so much more transparent than the GOP. So what happened?

They lied.

“No Taxation without Representation”, the phrase was coined by Reverend Jonathan Mayhew in a sermon in Boston in 1750, but it is found nowhere in the US Constitution, even though the concept is there in general. Some exceptions do exist, such as certain voting rights no being extended to convicts and immigrants. For most of its existence, Washington DC had no representation until the 23rd amendment came along.

So what do we do about this? It is obvious to anyone except the mushy-brained that the Obama administration is fully intent on turning the United States into a version of its preferred society, the old Soviet Union. Any who doubt that assertion should take a closer look at what Obama’s assorted “reforms” would do.

The Education Reform language inserted into the Healthcare Bill would make it illegal for an education to be privately funded. In the Healthcare Bill proper is language that would imprison a citizen daring to opt out of buying into ObamaCare. Actually the prison time is for not paying the massive fines attached to acting as a free person, but you’ll be behind bars just the same.

What really is happening is an assault on the very fabric of American Culture. If you boil down every complaint the left has against this country, it comes down to one essential phrase, and that phrase is this, “Life, Liberty, and the Pursuit of Happiness”. The liberal left cannot stand the fact of true individual freedom. They cannot handle the idea of a man or a woman being able to pursue the career of their choice. They cannot stomach the idea of you being able to express your opinion without fear of retribution. Remember what Hillary Clinton said about the nuclear family? “It Takes a Village” was a call to replace that mother and father with the Nanny State.

Nancy Pelosi told Congress that they had to vote for the Healthcare bill so they could find out what was in it, while at the same time the DNC is running television commercials claiming that the bill will provide an assortment of freedoms. If we tried to do that with Congress we would be indicted for contempt. The Life portion of our declaration will be deleted in the Healthcare bill through the formation of the so-called death panels, the Independent Medicare Advisory Boards called for in section 3403 of HR3200. The text of that section can be found here.

Those who claim that the “cost saving” decisions made by these boards would not make them death panels need to look at the new mammography guidelines called for by the government. If every American woman waits until she turns fifty before getting a check up, a good many of them will have already contracted inoperable cancer. The end result? Death…and a significant cost savings for Obama and the lefties. My wife’s mother could be one of them and a close friend of hers, another.

The Liberty portion has already gone, by the way, but not enough for the Democrats. Measures are already being discussed at the Reid and Pelosi level to make opposition to the government illegal. This type of legislation has been tried before, first with John Adams and the Sedition Act of 1798. Under the Obama form, it has been suggested that any opposition to the current administration be a punishable offense.

The Pursuit of Happiness would be eliminated by Cap and Trade. If passed, this would dictate what type of income you will be allowed to make and, in the dreams of the mushy-brained, the sort of career. Try to be the kind of entrepreneur that made this country great and you’ll be locked away.

What do we do? We have to make our representatives in both the Congress and Senate understand without any doubt that if they do not protect our rights and restore the freedoms the progressives have taken away…

They will be replaced.

Family feud: Nancy Pelosi at odds with President Obama

politico.com

House Speaker Nancy Pelosi’s increasingly public disagreements with President Barack Obama are a reflection of something deeper: the seething resentment some Democrats feel over what they see as cavalier treatment from a wounded White House.

For months, the California lawmaker has been pushing Obama hard in private while praising him in public. But now she’s being more open in her criticism, in part because she feels the White House was wrong — in the wake of the Democrats’ loss in Massachusetts — to push the Senate health care bill on the House when she knew there was no way it would pass.

Earlier this month, Pelosi criticized the president’s State of the Union call to exempt defense spending from a budget freeze. And in a White House meeting with leaders of both parties this week, she questioned the effectiveness of his plan to give small businesses tax breaks to hire workers.

“What you’re seeing now in public has been building in private,” said a top House Democratic official. “House members did their work — they did everything the president asked of them. And it gets stuck in the Senate. Or the Senate screws it up.”

Though Pelosi and other House Democrats have made it clear that they’re angry with the Senate, they’re also frustrated with the president, upset that he hasn’t come to terms with the problems of getting legislation through the upper chamber — or done enough to overcome them.

“He wants a jobs bill, we get a jobs bill,” the official said. “He wanted health care, we got health care. Then the answer is, ‘You just need to twist enough arms to pass the Senate bill.’ You can twist arms if you’ve got a handful of them to twist. You can’t twist over 100 arms. There needs to be some reality check there.”

“Both ends of the Capitol — the House and the Senate — are starting to wonder if they’re on their own,” the official continued. “You have a lot of frustration there. And the White House’s reaction to all of that seems to be, ‘Run against Congress’ — which, as you can imagine, doesn’t go over very well with House members. The White House reaction seems to be, ‘Position ourselves against Congress.’”Brendan Daly, Pelosi’s communications director, said a few tactical differences between the speaker and the White House have been overblown.

“There may be slight differences here and there, but the speaker is very supportive of the president and what he’s trying to accomplish — his agenda is our agenda,” Daly said. “And I think the White House is appreciative of her efforts because she’s been able to get his agenda through the House. There is shared frustration with the Senate — that because of Republicans’ overuse of the 60-vote rule, some things haven’t gotten through the Senate.”

White House senior adviser David Axelrod said inter-branch squabbling is to be expected — even when Congress and the White House are controlled by the same party.

“You’re feeling the effect of the worst recession since the Great Depression — it’s a bad political environment, and it’s particularly bad for the incumbent party,” Axelrod said. “That is axiomatic — that’s predictable. And it’s also predictable that there’s a lot of discomfort and a lot of disquiet in this town under those circumstances.”t

eams often have nasty locker rooms when they’re behind at halftime, and it would be easy to chalk up all the unhappiness to frayed nerves after Democrats failed to deliver on their big promises in 2009. But White House and Capitol Hill sources say there are much bigger issues at play here: confusion and political differences.

Neither Pelosi nor the White House knows whether Democrats can muster the 218 votes they need to pass health care or any other controversial measure through the House, despite their 77-vote majority. The loss of the Massachusetts Senate seat still has Democratic moderates in a state of shock and very reluctant to do anything that will turn off independent voters.

And the speaker is in an all-out war to save her majority. The political environment has deteriorated so much, so quickly that she now realizes Republicans could win back the House. Just two or three months ago, that was not considered a real possibility.

Pelosi’s focus is on keeping her majority — and her job. She wants to protect vulnerable members, but she also wants to accomplish some big things as speaker. This is a big reason she wants to pass health care reform and focus more on spending money on infrastructure than on cutting taxes for small businesses.

Obama obviously wants to keep control of the House and the Senate
, but it would be foolish for him to take his eye off 2012 — or his public image. This is a big reason the president is putting so much focus on reaching out to Republicans and making a public show of his bipartisan efforts.

One Democratic official went further, saying some Democratic House members actually believe that the White House “wouldn’t mind having a foil, and that foil is a Republican [House] majority — that would serve their political purposes going into 2012.”

These House Democrats say privately that veterans of Bill Clinton’s administration working in Obama’s White House may think having a Republican majority in Congress will help Obama win reelection, as it did Clinton in 1996. House Democrats know that Obama will do whatever it takes to win reelection, whether or not it helps members keep their seats this year.

Axelrod said it’s “natural for people to spin those kinds of theories, but they’re not based in reality. The president is going to be very active in trying to help those who have helped us move the country forward, and there shouldn’t be any doubt about that.”

Axelrod has worked personally to cultivate Pelosi. He was the headliner at an “issues conference” she hosted in August for her most loyal supporters — a sign of the importance he placed on the administration’s relationship with the speaker.

Axelrod said it is Pelosi’s prerogative to express differences but that relations are very good between the speaker and the White House. “She is a leader, and a strong leader, and she has her own constituencies both in the Congress and in her own district,” he said. “She’s been incredibly supportive and shown great leadership — not just partisan leadership but leadership for the good of the country. So I have no qualms with the speaker. We’re grateful for her.”

But Pelosi’s bluntness has occasionally grated on some in the White House.

“She is very clear and very realistic about what is possible in the House — whether it’s health care or climate change or the jobs bill, or any of the issues that have come up,” a House Democratic aide said. “She’s always very clear about where members are and what it will take to pass something. And it’s not something that is always a welcomed message.”

Her staff, her members and a lot of the Democratic leaders are still genuinely angry about all the heavy lifting they did last year — on health care, jobs and cap and trade — while, in their eyes, the White House played favorites with the Senate.

At the beginning of Obama’s presidency, he agreed to make cuts from the stimulus package in order to attract a few Senate Republicans, even though it made the measure less attractive to many key House members. And the House feels snubbed by the White House on health care talks because Democrats in the lower chamber were basically ignored while the administration courted a few Senate Republicans. The House-passed cap-and-trade bill has been all but abandoned in the Senate, and House members feel the Senate and the White House have ignored the jobs bill the House passed in December.

Another sore spot for House Democrats is fundraising. Pelosi has personally asked White House chief of staff Rahm Emanuel to attend events benefiting the Democratic Congressional Campaign Committee, which Emanuel chaired during the Democrats’ victorious 2006 campaign. But Emanuel has declined to do so, to Pelosi’s frustration, several Democratic insiders said.

'U.S. Military Serving as Chauffeurs, Babysitters for the Pelosi Kids:Receipts That Will Blow Your Mind

By Online: Jim Kelly Sunday, January 31, 2010

- Jim Kelly, Patriot Freedom

This article has too many photos and other items to load here. However, you have to go and look at the evidence.

Meet the Pelosi family! Using Freedom of Information Act (FOIA) requests, Judicial Watch uncovered thousands of pages of travel documents related to House Speaker Nancy Pelosi’s use of military aircraft.

What hasn’t been revealed so far is that military aircraft are being used to shuttle Pelosi’s kids and grandkids between DC and San Francisco without any Congressional representatives even onboard! Put simply, the United States Air Force is serving as a multi-billion dollar chauffeur- and baby-sitting service for Nancy Pelosi’s kids and grandkids—presumably because commercial travel is beneath the families of the autocrats. With the economy in a shambles and teetering on the brink of disaster thanks to the insane policies of the Democrats, this kind of waste is an outrage.
Nancy Pelosi—Air Force Documents

These documents were produced by the U.S. Air Force in response to a FOIA request for documents regarding House Speaker Nancy Pelosi’s use of Air Force transportation for Congressional Delegation (CODEL) travel.

AGAIN…PATRIOT FREEDOM SAYS Pelosi needs to resign as Speaker.

The scandal-plagued Speaker of the House has alienated nearly half of the country, earning an all-time low approval rating that makes her the least popular member of the Democratic Party
